General sales conditions of MOTOR YACHT CHARTER & Cie (hereafter referred to as MYC)
- Clause 1: “Obligations of MYC” The company MYC shall make available the motor yacht mentioned in the estimate accepted by the client chartering the vessel, duly fitted out with crew and equipment. The motor yacht is guaranteed seaworthy, and in a good state of repair and cleanliness. MYC vouches for the fact that the motor yacht complies with safety regulations currently in force as required by the different government administrations. MYC shall make available to the client all the mandatory documentation. The life-saving equipment shall comply with applicable regulations.
- Clause 2: “Booking terms”
- 1/ MYC will do everything in its power to ensure that the cruises and services take place as provided for in the booking, duly accepted by the client chartering the motor yacht. In no case can MYC be held liable for an alteration in the cruises and/or services outside of its control involving payment of compensation.
- 2/ The client chartering the motor yacht shall present themselves, at the boarding point, accompanied by all the passengers, at least 15 minutes before the scheduled departure time for the cruise. In the event of a late arrival, MYC shall reduce the duration of the cruise by the corresponding length of time, with no compensation.
- 3/ MYC declines all responsibility in the event of theft of, or damage to, passengers’ personal effects.
- 4/ For safety reasons and in order to preserve the motor yacht booked by the client, it is strictly FORBIDDEN to walk around the motor yacht with aggressive town shoes (for example, high heels). MYC reserves the right to refuse access on board to any passenger who refuses to comply with this contractual condition.
MYC, represented on board by its captain, reserves the right to interrupt temporarily or definitively a cruise as a result of abnormal behaviour (drunkenness, behaviour under the influence of drugs, etc.) that could endanger the lives of the passengers or other persons. - 5/ Financial terms:
- signing of a prior contract
- payment of 50% of the cost of the services on signing the contract
- payment of the balance one month before the start of the cruise/services to be provided
N.B: Any cruise/service that has not been paid for by the due date shall result in the cancellation of the cruise/services and the retaining by MYC of compensation as provided for below (heading: “Cancellation by the client chartering the motor yacht”).
- Clause 3: “Terms of cancellation”
As cruises are subject to the rules governing inland navigation and as our company reserves the right to determine whether or not a given zone is navigable for the motor yacht, the cruises may be altered or cancelled at any time from the time of the booking, without compensation. In this case, the client shall choose whether the cruise/services shall be provided on the quayside or whether to postpone the cruise/services to a later date to be agreed, on identical booking terms if the chosen date is in the same calendar year, or at the applicable price if the chosen date is in a subsequent calendar year.
- Cancellation by the client chartering the motor yacht.
- Cancellation more than 30 days before the scheduled date for the cruise/services: 30% of the price, tax included, of the cruise/services shall be retained by MYC for overheads incurred.
- Cancellation less than 30 days before the scheduled date for the cruise/services: 50% of the price, tax included, of the cruise/services shall be retained by MYC.
- Cancellation less than 10 days before the scheduled date for the cruise/services or failure by the client to present themselves for the departure: 100% of the price, tax included, of the cruise/services shall be retained by MYC. Acceptance of our general conditions is an essential condition of the present booking agreement, without which bookings cannot be agreed. For all disputes, the competent courts shall be solely those in whose jurisdiction the registered offices of MYC are located.
